1. Introduction

1.1. These terms and conditions govern the use of the job alerts subscription service (“Service”) offered by Voyage Global Company (“Company”, “we”, “us”, or “our”) to its customers (“Customers”, “you”, or “your”).

2. Subscription Service

2.1. By subscribing to our job alerts service, you agree to receive notifications and updates about job opportunities relevant to your preferences and interests.

2.2. You understand that the job alerts are based on the information provided by you during the subscription process, including your job preferences, skills, and location.

3. Subscription Process

3.1. To subscribe to our job alerts service, you must provide accurate and complete information about yourself, including your name, email address, job preferences, and any other required details.

3.2. You agree to update your subscription preferences promptly if there are any changes to your contact information or job preferences.

4. Frequency and Content of Alerts

4.1. We strive to provide timely and relevant job alerts to our subscribers. However, we do not guarantee the frequency or availability of job alerts, as this may vary depending on factors such as job availability and your specified preferences.

8.1. These terms and conditions shall be governed by and construed in accordance with the laws of Zimbabwe constitution. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Zimbabwe constitution.

9.1. You are solely responsible for maintaining the confidentiality of your subscription information, including any username or password associated with the service.

9.2. You agree not to share your subscription credentials with any third party or allow unauthorized access to your account.

10. Acceptable Use

10.1. You agree to use the job alerts service only for lawful purposes and in accordance with these terms and conditions.

10.2. You shall not use the service to transmit, distribute, or store any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

11. Intellectual Property

11.2. You may not reproduce, distribute, modify, or create derivative works based on the content provided through the service without the prior written consent of Voyage Global Company.

12. Indemnification

12.1. You agree to indemnify, defend, and hold harmless Voyage Global Company, its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including attorneys’ fees) arising out of or in connection with your use of the job alerts service or any violation of these terms and conditions.

13. Severability

13.1. If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.

14. Entire Agreement

14.1. These terms and conditions constitute the entire agreement between you and Voyage Global Company regarding the job alerts subscription service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between the parties with respect to the subject matter herein.

16. Amendment

16.1. Voyage Global Company reserves the right to amend or modify these terms and conditions at any time without prior notice. Your continued use of the service after such changes constitutes acceptance of the updated terms and conditions.

17. Waiver

17.1. The failure of Voyage Global Company to enforce any provision of these terms and conditions shall not be deemed a waiver of such provision or any other provision herein. The waiver of any provision shall be effective only if in writing and signed by an authorized representative of Voyage Global Company.

18. Force Majeure

18.1. Voyage Global Company shall not be liable for any failure or delay in performing its obligations under these terms and conditions due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or governmental actions.

19. Assignment

19.1. You may not assign or transfer any of your rights or obligations under these terms and conditions without the prior written consent of Voyage Global Company. Voyage Global Company may freely assign or transfer its rights and obligations under these terms and conditions without restriction.

20. Language

20.1. These terms and conditions may be translated into other languages for convenience. In the event of any discrepancy between the English version and any translated version, the English version shall prevail.

21. Feedback

22. Effective Date

22.1. These terms and conditions are effective as of Date of  payment and shall remain in effect until terminated in accordance with Section 6 (Modification and Termination) herein.

23. Disclaimer of Warranty

23.1. THE JOB ALERTS SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, VOYAGE GLOBAL COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS.

23.2. VOYAGE GLOBAL COMPANY DOES NOT WARRANT THAT THE JOB ALERTS SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR DOES IT MAKE ANY WARRANTY REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE.

24. Limitation of Liability

24.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOYAGE GLOBAL COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO OR USE OF THE JOB ALERTS SERVICE OR ANY CONTENT PROVIDED THROUGH THE SERVICE.

24.2. IN NO EVENT SHALL VOYAGE GLOBAL COMPANY’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND CONDITIONS OR THE JOB ALERTS SERVICE EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SERVICE DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

25. Interpretation

25.1. The headings and titles in these terms and conditions are for convenience only and shall not affect the interpretation of the provisions herein.

25.2. References to “including” shall mean “including, but not limited to.”

26. Survival

26.1. Sections 7 (Limitation of Liability), 23 (Disclaimer of Warranty), 24 (Limitation of Liability), and any other provisions which by their nature should survive termination, shall survive any termination or expiration of these terms and conditions.

27. Entire Agreement

27.1. These terms and conditions, together with any other policies or agreements referenced herein, constitute the entire agreement between you and Voyage Global Company regarding the job alerts subscription service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between the parties with respect to the subject matter herein.
